Controlled Action under EPBC Act The Commonwealth Department of Environment and Water Resources determined that the proposed development is a "controlled action" under the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act). The EPBC Act Part 3, Division 1 controlling provisions are: - sections 18 and 18A (Listed threatened species and communities); and - sections 20 and 20A (Listed migratory species). The project will be assessed under Part 3A of the Environmental Planning and Assessment Act 1979. The assessment will be in accordance with clause 13.2 of the Bilateral Agreement between NSW and the Commonwealth, made under the EPBC Act, relating to environmental impact assessment. The assessment will be done in the manner specified in Schedule 1 of the Bilateral Agreement. |
